These Terms govern your use of the On Avail web app and the On Avail Quick Import browser extension. By creating an account or using On Avail, you agree to these Terms and acknowledge our Privacy Policy.
On Avail ("On Avail," "we," "us") is operated by Marburger Consulting LLC, 204 Gauge Court, Stewartstown, Pennsylvania 17363, USA. Contact: info@onavail.app. On Avail is a career-tracking tool for performers and other entertainment-industry professionals.
On Avail is currently offered only to individuals who are at least 18 years old and whose primary residence is in the United States. On Avail is not currently offered to residents of other countries. A U.S.-based subscriber may access On Avail while temporarily traveling or working outside the United States, subject to applicable law.
For these Terms, "United States" means the fifty states, the District of Columbia, and U.S. territories (including Puerto Rico, Guam, and the U.S. Virgin Islands).
If we determine that an account does not satisfy these eligibility requirements, we may suspend or terminate the account and provide any refund required by applicable law or our stated refund policy (Section 6). An ineligible account does not automatically forfeit amounts already paid.
You must be at least 18 and a U.S. resident to create and control an account (see Section 2). A parent or legal guardian may use their own adult-controlled account to maintain career information about their minor child; minors may not independently create or control an account. You are responsible for the accuracy of your account information, for keeping your login secure, and for activity that occurs under your account.
On Avail is a record-keeping and organization tool. It does not provide legal, tax, accounting, financial, employment, or career advice. Nothing in the app — including income totals, expense categories, deduction hints, or any calculated figure — is professional advice, and you should confirm your own tax, legal, and financial obligations with a qualified professional. You are responsible for the accuracy of the data you enter and for your own filings and decisions.
Some features use AI to extract or generate information from content you provide (see the Privacy Policy, "AI features"). AI output can be inaccurate or incomplete; it is a draft for you to review and correct before relying on or saving it. You are responsible for reviewing AI-generated results.
Paid subscriptions are billed through Stripe in U.S. dollars. By subscribing you authorize recurring charges until you cancel. You can cancel at any time; cancellation stops future renewals and takes effect at the end of the current billing period. Except where required by law, payments are non-refundable and we do not provide refunds or credits for partial billing periods. If we offer a free trial, its length and what happens when it ends will be disclosed at signup. We may change subscription prices; we will give you advance notice before a change takes effect, and your continued use after that constitutes acceptance of the new price.
If you were referred by a promotional partner, a share of your subscription may be paid to that partner through Stripe; this does not change what you pay. See the Privacy Policy for what that partner does and does not receive.
All amounts in On Avail are recorded and displayed in U.S. dollars. On Avail does not perform currency conversion, does not guarantee exchange rates, and does not determine the tax, accounting, or legal treatment of any income. If you are a U.S.-based performer paid in a foreign currency for work done abroad, you are responsible for converting those amounts to U.S. dollars (using a source and rate of your choosing) before entering them.
You agree not to: use On Avail for unlawful purposes; attempt to access other users' data or our systems without authorization; interfere with or disrupt the service; reverse engineer or resell the service except as allowed by law; or upload content you don't have the right to store. You are responsible for the information you enter about other people (such as contacts and casting personnel) and represent that you may lawfully store it.
You retain ownership of the data you enter. You grant us the limited rights needed to host, process, and display it back to you and to operate the features you use (including sending content you submit to AI features to our processor, as described in the Privacy Policy). You can export your data at any time and can request account deletion; see the Privacy Policy for retention and deletion details.
On Avail relies on third-party service providers (including Supabase, Anthropic, Stripe, Vercel, and Cloudflare) to operate, and may link to or interact with third-party websites and services. Your use of those services is governed by their own terms and privacy practices, and we are not responsible for them. If you use the On Avail Quick Import browser extension, your use of Chrome and of any website you visit is likewise governed by those third parties' terms.
We may modify, suspend, or discontinue features, and we may update these Terms; for material changes we'll update the effective date and provide notice as described in the Privacy Policy. We may suspend or terminate accounts that violate these Terms or that are ineligible under Section 2. You may stop using On Avail and close your account at any time.
On Avail is provided "as is" and "as available," without warranties of any kind to the fullest extent permitted by law. We do not warrant that the service will be uninterrupted, error-free, or that stored figures are accurate for tax, legal, or financial purposes.
To the fullest extent permitted by law, On Avail and Marburger Consulting LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any lost profits, revenues, data, or goodwill. Our total liability for any claim relating to On Avail will not exceed the greater of (a) the amount you paid us for On Avail in the twelve months before the claim, or (b) US $100.
These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict-of-laws rules. Before filing any claim, you agree to first contact us at info@onavail.app so we can try to resolve the matter informally. Any dispute not resolved informally will be brought exclusively in the state or federal courts located in Pennsylvania, and you consent to the personal jurisdiction of those courts.
